Estate Planning is more than planning for death.  A good Estate Plan will protect you at incapacity.  You -not the courts- keep control of your assets and decisions about your medical care when you are still alive but no longer able to handle your affairs.  This is why you must include a  Durable Power of Attorney and an Advanced Healthcare Directive in your Estate Plan.
